Welcome to Wissens World. These Terms and Conditions ("Terms") govern your access to and use of the website www.wissensworld.com ("Website") and the services provided by Wissens World ("Company", "We", "Us", "Our"), a premier language training and consulting institute based in Pune, Maharashtra, India.

By accessing this Website, enrolling in a course, or engaging our translation/staffing services, you ("User", "Student", "Client", "Trainer") agree to be bound by these Terms. If you do not agree, please do not use our services.

1. Definitions

• "Services" refers to language training (online/offline), translation, interpretation, exam registration assistance (TOEFL/IELTS), and language expert staffing provided by the Company.
• "Course Materials" means all digital or physical learning resources, including but not limited to PDFs, audio files, video lectures, and handouts provided by Wissens World.
• "Trainer" refers to any language instructor, freelance expert, or corporate trainer engaged by Wissens World.
• "Partner" associative companies or individuals, indicatively refers to any freelance contractual translators, Interpreters and marketing companies engaged with Wissens World.
• "Confidential Information" refers to proprietary teaching methods, student databases, business strategies, and client details.

2. Enrollment and Educational Services

2.1. Registration & Eligibility

• You must provide accurate, current, and complete information during the registration process.
• Access to online portals is personal. Sharing login credentials with third parties is strictly prohibited and will result in immediate termination without refund.

2.2. Fees and Payment

• Course Fees: Fees must be paid in full or via approved installment plans prior to the commencement of classes.
• Taxes: All fees are exclusive of applicable taxes (GST) unless otherwise stated.
• Non-Refundable: Fees once paid are non-refundable and non-transferable to another individual or course, except in exceptional scenarios at the sole discretion of Management. We understand that circumstances can change. While fees are generally non-refundable to cover administrative and reservation costs, we offer a flexible refund window:
  Refund Grace Period: We aim to be accommodating; therefore, refund requests are accepted if made within 45 days of payment or before attending the first 3 sessions of the course (whichever occurs earlier).
• Institute Cancellation: In the unlikely event that Wissens World is unable to commence the course on the scheduled start date, students are entitled to a full refund of the fees paid.
• Installment Default: If a User on an installment plan fails to pay by the due date, Wissens World reserves the right to suspend access to classes and withhold certification.

2.3. Exam Registration (Third-Party Disclaimer)

• Wissens World acts solely as a facilitator for registering students for third-party exams (e.g., TOEFL, IELTS, Goethe-Institut exams).This service is provided to facilitate the exam registration process.
• No Liability: We are not responsible for exam cancellations, technical glitches, result delays, or scoring disputes managed by external bodies (e.g., ETS, British Council).
• Exam Fees: Fees for these exams are payable directly to the respective organizations. Any exam fee collected by us is passed on to the testing body and is subject to their specific refund policies.

3. Student Code of Conduct (Online & Offline)

To maintain a professional learning environment, all Students agree to the following:

• Virtual Classroom Etiquette: Language learning requires visual cues and active engagement. Students must keep their cameras ON if requested by the Trainer. Inappropriate background noises, distractions, or attire are not permitted.
• Audio Hygiene: Microphones must remain muted when not speaking to prevent background noise (traffic, family members, television) from disrupting the class. Unmute only when called upon or during group discussions.
• Zero Tolerance for Harassment: Use of abusive language, bullying, sexual harassment, or disruptive behavior toward Trainers or fellow students will lead to immediate expulsion under the Prevention of Sexual Harassment (POSH) Act and other applicable laws.
• Technical Responsibility: It is the student's responsibility to ensure a stable internet connection and functioning hardware (headset/mic). Class time will not be used to troubleshoot individual student technical issues.
• Respectful Communication: Interruption of the trainer or other students is discouraged. Students should use the "Raise Hand" feature in the video conferencing tool to ask questions.
• Chat Usage: The chat box is for academic queries only. Spamming, sharing irrelevant links, or private messaging other students for non-academic purposes is strictly prohibited.
• Prohibition on Recording: Students are strictly prohibited from recording (audio or video) any live sessions. All class recordings are the exclusive Intellectual Property of Wissens World.
• Privacy: Sharing the personal details of trainer or other student without their explicit consent would be considered violation of privacy.
• Safety: The safety of our students is paramount. Any behavior deemed threatening, including stalking, loitering, following a student or trainer after class, or unwanted physical approaches outside the institute premises, will be treated as a severe violation of these Terms.
• Extended Jurisdiction: While Wissens World is not liable for personal disputes occurring outside its physical premises, the Institute reserves the right to terminate the enrollment of any student whose off-campus behavior (e.g., harassment/bullying of peers) creates a hostile environment within the classroom.

4. Terms for Trainers and Partners (NDA)

This section applies to all Trainers, Interpreters, and Corporate Partners engaged by Wissens World.

4.1. Confidentiality (NDA)

Trainers acknowledge that during their engagement, they will have access to Confidential Information (student lists, proprietary curriculum, client contracts). Trainers agree to keep all such information strictly confidential and not to disclose it to any third party or use it for personal gain outside the scope of their agreement with Wissens World. This obligation survives the termination of the engagement.

4.2. Non-Solicitation & Non-Poaching

Trainers agree that during the term of their engagement and for a period of twelve (12) months thereafter, they shall not directly or indirectly solicit, induce, or attempt to provide private tuition or freelance services to any Student or Corporate Client of Wissens World introduced to them through the Company.

4.3. Intellectual Property Assignment

Any content, course material, or curriculum developed by a Trainer specifically for a Wissens World course shall be the sole property of Wissens World ("Work for Hire" under the Copyright Act, 1957). The Trainer waives all moral rights to such content.

5. Translation and Interpretation Services

• Accuracy Disclaimer: While we strive for high accuracy, language translation is subjective. Wissens World is not liable for stylistic differences or minor nuances unless a specific glossary was provided by the Client.
• Liability Cap: In the event of a material error in translation that leads to financial loss, the Company’s liability is strictly limited to the value of the invoice amount paid for that specific service. We are not liable for consequential damages (e.g., printing costs, loss of business).

6. Intellectual Property Rights (IPR)

• Ownership: All content on the Website and in the classrooms (logos, text, graphics, course modules) is the intellectual property of Wissens World.
• Limited License: Users are granted a limited, non-exclusive license to use the materials for personal study only.
• Violations: Reproduction, redistribution, or commercial sale of our course materials is a violation of copyright law and will result in legal action.

7. Limitation of Liability and Indemnity

All services are provided on an "as is" and "as available" basis. We do not guarantee that the results of our training will meet your specific expectations (e.g., guaranteeing a specific exam score). You agree to indemnify and hold harmless Wissens World from any claims arising from your violation of these Terms.

8. Governing Law and Jurisdiction

• Jurisdiction: These Terms are governed by the laws of the Republic of India.
• Dispute Resolution: In the event of any dispute, the parties shall first attempt to resolve it amicably. If unresolved, the dispute shall be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996. The seat of arbitration and exclusive jurisdiction shall be Pune, Maharashtra.
